Four fines following prison injury

Four different parties have been find after a worker was injured when replacing a window at Leeds prison. The worker suffered multiple fractures in his right foot, a fracture of his left ankle and significant soft tissue damage in both feet.

Stuart Tombs was the site manager through his own company SJT Site Management Limited. SJT Site Management was was contracted by Longcross Construction Limited, which was acting as the principal contractor for the window replacement. Longcross Construction Limited then subcontracted Fewell Engineering Limited for the work.

An employee of SJT Site Management was operating a MEWP and driving it to the location of the work when one of the wheels struck an employee of Fewell Engineering, who was pushing a trolley with the new window on it. The MEWP then partially ran over the worker's feet.

A Health and Safety Executive (HSE) investigation into the incident found that Longcross Construction Limited, Fewell Engineering and SJT Site Management Limited all failed to prepare suitable and sufficient risk assessments and method statements for the operation. Furthermore, it was discovered that site manager Stuart Tombs had forged or fabricated site health and safety documents in an attempt to deflect responsibility.

All four pleaded guilty to breaching the Health and Safety at Work etc. Act 1974 and were issued with the following fines:

  • Fewell Engineering Limited - £20,000 and costs of £702;
  • Longcross Construction Limited - £20,000 and costs of £303;
  • SJT Site Management Limited - £600 and costs of £199;
  • Stuart Tombs - £100 and costs of £149.
