Dr. Andrew Boswell has won the right to appeal against government planning permission for improvements to the A47 in Norfolk.
This was the second attempt to appeal the legality of the works, with the first being rejected in July. The objections focus on the carbon emissions that would be caused by the road improvements.
On Boswell's crowd funding page its says "Four massive road building projects are poised to devastate countryside around the historic city of Norwich by 2025. If built, they would destroy precious wildlife habitats, increase development pressures and generate more traffic 'needing' further road building".
The three proposals relating to the A47 signed off by the government are:
Lord Justice Coulson, handling the decision, said that the appeal had "a real prospect of success".
Dr Boswell commented on the decision: "My determination to see carbon emissions properly assessed on road schemes has been vindicated.
"We are not seeing any real reduction in carbon pollution from UK roads, or Norfolk roads, and success in the Appeal Court would have wider implications for the government's failing climate strategy, especially on transport.
"The legal case for appeal from my lawyers is very clear, and very strong, and we will now put all our energies into winning this case."
The legal action is being crowd funded and Boswell has secured £61,685, with an aim of £75,000.
